UK Grants Asylum to Afghan Migrant Previously Convicted of Rape in Austria

An Afghan national convicted of rape in Austria was granted asylum in United Kingdom following a series of administrative failings by the Home Office.
Omar Ali Noori, 31, was arrested in 2018 in Linz after being accused of raping a woman. He was later released on bail, but instead of remaining in the country to face legal proceedings, he absconded and fled Austria. The following year, he entered the United Kingdom.
Despite his prior arrest and subsequent conviction, Noori was granted indefinite leave to remain in Britain in 2023. Court records indicate that his 23-year-old wife later joined him in the UK under family reunification provisions.
Further details that emerged during legal proceedings raised serious concerns about his credibility. Official documents revealed that Noori had used four separate identities and listed five different dates of birth across various applications. During extradition hearings, Judge Neeta Minhas referred to him as a “fugitive,” noting that he had provided false information to authorities.
According to the court, Noori had been directly asked whether he had ever committed, been accused of, or been detained for an offence in any country. He denied all such allegations. The judge determined that these responses were clearly inaccurate and concluded that he had deliberately misled officials.
Judge Minhas ordered that Noori be extradited to Austria to serve his prison sentence. The Afghan national is currently being held at HM Prison Wandsworth and is expected to appeal the extradition ruling.
